1. Operator and acceptance

SWARTER is operated by Swarter SP LLC - FZ, Fujairah Free Zone, M1 Floor, Twin Towers, Fujairah, United Arab Emirates (the “Company”). These Terms govern access to the SWARTER app and website. By registering, users agree to these Terms and the Privacy Policy. The Company may update these Terms with appropriate notice where required.

2. Eligibility and accounts

Users must be at least 18 years old and located in the United Arab Emirates. Registration is by verified email; users may be asked for name, age, mobile number and city/area. Users are responsible for account security, accurate information and activity through their accounts. Multiple accounts may be permitted using separate emails, but must not be used for abuse, evasion or fraud. SWARTER does not verify government identity documents.

3. Free barter-only service

Listing and exchanging items on SWARTER are free of charge. The service facilitates exchanges of one item for one or more other items. Cash top-ups, money payments and selling items through an exchange arrangement are prohibited. SWARTER does not offer in-app delivery, wallet, points or escrow services under the current model.

4. Listings and pre-publication review

Users must own or be authorized to exchange their items and describe them accurately, including defects, images and any limitations. SWARTER may review listings for apparent policy compliance before publication and remove prohibited or misleading items. Such review is not a physical inspection, authenticity check, functionality test or guarantee of safety, condition, title or legality.

5. Acceptance and completion

An exchange is accepted when both users confirm it in the app, following an on-screen reminder of their responsibilities. After acceptance, the app provides no ordinary cancellation button. Users remain responsible for agreeing on and performing the physical handover. If no issue is reported within 48 hours after mutual acceptance, the transaction is automatically marked “Completed” in the app. This status is administrative only and does not prove delivery, receipt or satisfactory condition of any item.

6. Complaints and internal moderation

An issue concerning an accepted exchange should be reported within 48 hours after mutual acceptance via support@swarter.com or other channels made available in the app. A timely report pauses automatic completion until the support team reviews it. SWARTER may examine the preserved listing photos and specifications, relevant conversations and evidence provided, and may restrict accounts or remove content when a breach is substantiated. The Company does not undertake to recover property, enforce a user-to-user exchange, award compensation or act as an arbitrator. No internal appeal mechanism is currently offered. These internal time limits do not restrict rights available under mandatory law or the ability to contact competent authorities.

7. Direct chat and handover

Users communicate directly and can share contact details voluntarily. The parties independently arrange pickup or handover and are responsible for personal safety and meeting arrangements. SWARTER does not arrange transportation or physically handle items. Users must not threaten, harass, impersonate others, solicit payments for barter exchanges or misuse other users’ personal information.

8. Prohibited items and activity

Prohibited items include weapons, explosives, illegal drugs, dangerous or restricted chemicals, controlled/prescription medicines where exchange is unlawful, stolen or counterfeit goods, forged documents, unlawfully obtained accounts or personal data, prohibited wildlife products, obscene or unlawful materials, and any goods whose trade or transfer is illegal under UAE law. Items subject to licensing or regulatory restrictions must not be listed without all required permissions; SWARTER may reject them. Fraud, misleading claims, infringement of intellectual property and abuse of the platform are prohibited.

9. Allocation of responsibility

An exchange is an agreement solely between users; SWARTER is not a seller, purchaser, owner, guarantor or party to their agreement. Users bear primary responsibility for item descriptions, ownership, fitness, condition, legality and performance of the agreed handover. To the fullest extent permitted by applicable law, SWARTER is not responsible for losses arising solely from an independent user’s breach or misrepresentation. Nothing excludes liability for SWARTER’s own acts or omissions where exclusion is prohibited by applicable UAE law, including mandatory consumer or data-protection obligations.

10. Reports, authorities and enforcement

SWARTER may preserve records, investigate reports and cooperate with competent UAE authorities in response to lawful requests. Users may approach the police, courts or other competent authorities independently. SWARTER is not required under these Terms to initiate a police complaint for a user.

11. Data and intellectual property

Processing of personal data is described in the Privacy Policy. Users grant SWARTER a non-exclusive license to host and display their listing content for operating the platform, subject to applicable laws and account deletion obligations. Users confirm they have rights to the content they upload. SWARTER branding and platform materials remain protected by applicable rights.

12. Suspension, deletion and records

SWARTER may remove listings or suspend accounts for suspected abuse or confirmed violations, subject to applicable law. Account deletion is available in the app. Certain swap records and conversations may be retained for up to six months after account deletion for safety and fraud prevention, subject to lawful retention and erasure requirements. Transaction history may remain visible to the other participant with personal information minimized where appropriate.

13. Law, contact and changes

These Terms are governed by applicable laws of the United Arab Emirates, subject to mandatory jurisdiction and consumer-protection rules. Contact: support@swarter.com. The current business address is M1 Floor, Twin Towers, Fujairah, UAE.
